Terms of Service

By using Can We Trust It? you agree to the following terms. If you do not agree, please do not use the service. These terms constitute a binding agreement between you and GIK TOK LLC.
1. Nature of the service
Can We Trust It? uses AI to detect patterns in submitted text or images that may be associated with scams or fraud. Results are AI-generated pattern detection only. They are provided for informational purposes. They do not constitute legal advice, a guarantee of accuracy, or a definitive determination of whether any particular content or sender is fraudulent or safe.
The service uses probabilistic language (“high-risk patterns detected,” “suspicious patterns detected”) rather than declarative claims (“this is a scam”) because no automated system can determine with certainty whether any specific message is fraudulent.
2. Free and paid plans
The service offers a free tier (3 text checks per IP per 24 hours, no image checks) and paid subscription plans (Lite, Standard, Pro, Business) available on monthly or yearly billing periods. Plan details and prices are shown on the site at the time of purchase. We may change plan prices and features from time to time; changes affect new subscriptions and renewals only, and existing subscribers will continue at the price they signed up at for the current billing period.
3. No warranty
The service is provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any particular result is accurate.
4. User responsibility
You assume full and sole responsibility for any decisions you make based on results produced by this service. GIK TOK LLC accepts no liability for actions taken or not taken in reliance on any analysis provided.
5. Wall of Shame
If you choose to share a scam to the public Wall of Shame, you grant GIK TOK LLC a non-exclusive, royalty-free, worldwide license to publish, display, and store the scrubbed (anonymized) version of your submission as part of a public corpus of scam warnings. You retain whatever rights you had in the original content; we only display the scrubbed version.
You may request removal of any Wall entry you submitted at any time by emailing appeals@canwetrustit.com.
You agree not to submit content to the Wall that:
- –Is not in good faith a scam or fraud attempt.
- –Contains personally identifying information of a real third-party victim that has not been redacted by our scrubbing process.
- –Defames a real, named, legitimate business.
We reserve the right to remove any Wall entry at our sole discretion, with or without notice.
6. Limitation of liability
To the maximum extent permitted by applicable law, GIK TOK LLC’s total aggregate liability to you for any claims arising from or related to the service is limited to the greater of (a) the amount you paid to GIK TOK LLC in the 12 months preceding the claim, or (b) $100.00 USD. GIK TOK LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
7. Acceptable use
You agree not to:
- –Use the service to analyse content for any unlawful purpose.
- –Attempt to reverse-engineer, scrape, or automate access to the service in ways that bypass our rate limits or plan limits.
- –Submit content containing personally identifiable information of third parties without their consent, except where such information is part of a scam communication you received and are seeking to analyse.
- –Circumvent or attempt to circumvent rate limits, paywalls, or payment requirements.
- –Submit content to the Wall of Shame that does not in good faith appear to be a scam or fraud attempt.
- –Submit malware, illegal content, or content that infringes the intellectual property of others.
8. Account and access
If you create a paid account, you are responsible for maintaining the security of the email address associated with your account. The magic-link sign-in system means anyone with access to your email can sign in. We are not liable for unauthorized access resulting from compromise of your email account.
9. Cancellation and termination
You may cancel your subscription at any time via the Stripe billing portal accessible from your account page. We may suspend or terminate your access if you breach these Terms.
10. Dispute resolution and arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the service shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, rather than in court. You waive any right to a jury trial or to participate in a class-action lawsuit. This clause does not prevent either party from seeking injunctive relief in court for intellectual property infringement.
11. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
12. Changes to these Terms
We may update these Terms from time to time. Continued use of the service after any changes constitutes your acceptance of the revised Terms. The “Last updated” date at the top of this page indicates when the Terms were last revised. For material changes that affect your rights, we will make reasonable efforts to notify you.
